Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Remembranch service (the "Service"), provided by K2021499496 trading as "Remembranch" ("we", "us"). By using the Service you agree to these Terms.

1. Your account

You must provide accurate information, keep your credentials confidential and are responsible for activity under your account. You must be of legal age to contract, or have authority to bind the family/organisation on whose behalf you use the Service.

2. Acceptable use

You must not misuse the Service, including by: (a) using it unlawfully; (b) uploading content you don't have rights to; (c) transmitting malware, spam or fraudulent content; (d) probing, scanning, scraping or otherwise interfering with the Service's security or availability; (e) infringing anyone's intellectual property or privacy.

3. Your content

You retain ownership of the memories, photos and content you upload. You grant us a limited, non-exclusive licence to host, store and process that content solely to operate and provide the Service to you and the people you invite.

4. Intellectual property

The Service, its software, design, branding and documentation are and remain our property (or that of our licensors). We grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan.

5. Payment, subscriptions & tax

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing frequency, renewals, taxes, cancellations and refunds are governed by Paddle's Buyer Terms in addition to these Terms and our Refund Policy.

6. Service availability

We work to keep the Service running, but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

7. Suspension & termination

We may suspend or terminate access if you materially breach these Terms, fail to pay, or create a security, fraud or abuse risk. You may cancel at any time via your account or through Paddle. On termination we will provide a reasonable window to export your content before deletion.

8. Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of the Service is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect, consequential, incidental or special damages (including lost profits, data or goodwill). Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be limited by law.

9. Indemnity

You will indemnify us against third-party claims arising from your content, your unlawful use of the Service or your breach of these Terms.

10. Changes

We may update these Terms from time to time. Material changes will be notified via the Service or by email; continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the exclusive jurisdiction of the South African courts, without prejudice to mandatory consumer-protection rights in your country of residence.
